Library Rules of Conduct
LB RESOLUTION 04-02
A RESOLUTION OF THE BOARD OF LIBRARY TRUSTEES OF THE CITY
OF MISSION VIEJO ESTABLISHING REGULATIONS FOR CONDUCT
WITHIN AND AROUND THE MISSION VIEJO LIBRARY
THE BOARD OF LIBRARY TRUSTEES OF THE CITY OF MISSION VIEJO
DOES RESOLVE AS FOLLOWS:
Section 1. Purpose. The Mission Viejo Library
(“Library”) and its grounds (“Library Grounds”) have been
established to provide a place where the public can
comfortably review a wide variety of materials and otherwise
read, learn, and study. To fulfill this purpose, the Board
of Library Trustees (“Board”) deems it necessary to prohibit
conduct that is disruptive to the operation of the Library.
The purpose of this Resolution is to define behavior that is
unacceptable within the Library and on the Library Grounds.
Section 2. Prohibited Conduct. No person shall do any
of the following:
a. Destroy, injure, deface any Library property, including
without limitation, books magazines, furniture, fixtures,
computer equipment, computer systems, computer software, and
programs;
b. Smoke or consume tobacco products within the Library or
on the Library Grounds other than in an area that has been
designated for such activity.
c. Engage in an activity or conduct in the Library or on the
Library Grounds, after being asked to stop by a Library
employee, that a reasonable person would consider to be
disturbing;
d. Bring a bicycle, skateboard, roller blades, roller skates
or other wheeled toy or device into the Library or onto the
Library Grounds other than to store such item in a storage
area designated by the City Librarian;
e. Ride a bicycle on the Library Grounds other than on the
driveway and parking lot area while accessing or exiting a
bicycle parking area designated by the City Librarian;
f. Ride a skateboard, roller blades, roller skates, or other
wheeled toy or device on the Library Grounds;
g. Carry, lead, or bring an animal in the Library or cause
an animal to enter the Library, provided, however, that this
provision is not applicable to disabled persons utilizing
identified service animals;
h. Carry, lead, or bring onto Library Grounds an animal that
is not leashed and under continuous direct and immediate
human control;
i. Posses a gun, knife, or similar weapon in the Library or
on the Library Grounds, provided, however, that this
provision shall not apply to any peace officer licensed to
carry a weapon;
j. Lie down, doze, or sleep in the Library;
k. Possess any bottle, can or other container containing an
alcoholic beverage or consume an alcoholic beverage while in
the Library or on the Library Grounds, provided however,
that this provision shall not apply to persons attending
special events approved by the City Council;
l. Be under the influence or in possession of a controlled
substance (as defined in Health and Safety Code Section
11007) in the Library or on the Library Grounds;
m. Be in the Library before or after operating hours without
receiving permission from a Library employee;
n. Possess any food or beverages or consume any food or
beverages in the Library, provided, however, that this
provision shall not apply to persons attending approved
special events in the Community Room;
o. Make a persistent noise or noises in the Library or on
the Library Grounds, after being asked to stop by a Library
employee, that a reasonable person would consider
disturbing;
p. Engage in any fund-raising activity in the Library or on
the Library Grounds, provided, however, that this provision
shall not apply to person affiliated with nonprofit
organizations conducting an approved fund-raising event in
the Community Room;
q. Allow a child for whom such person is responsible to
damage library property or to engage in an activity that a
reasonable person would consider disturbing;
r. Use a cell phone or pager (beeper) in the Library. Cell
phones and pagers must be turned off or turned to vibrating
mode before entering the Library.
s. Leave a child under the age of ten unattended in the
Library or on the Library Grounds.
Section 3. Penalty. Pursuant to Education Code
Section 18960, a Library employee may eject from the Library
and the Library Grounds any person who engages in conduct
prohibited by this Resolution. The City Librarian may
rescind the library privileges of any person who repeatedly
engages in conduct prohibited by this Resolution.
Section 4. The Secretary shall certify to the
adoption of this Resolution.
PASSED, APPROVED AND ADOPTED this 15th day of November,
2004.

adopted by the Library Board of Trustees of the City of
Mission Viejo at a regularly scheduled meeting therof, held
on the 15th day of November, 2004, by the following vote of
the Board:
